DUI Charge Dismissed Involving Test By TBI Lab Expert Who Was Terminated

Tuesday, November 12, 2013

A DUI charge was dismissed in General Sessions Court on Tuesday after a defense attorney pointed out it was one of those handled by a TBI lab employee who was terminated after he mixed up two blood alcohol tests.

General Sessions Court Judge Clarence Shattuck agreed to the dismissal after he advised Christian Lorenzen that there was a chance that the case could be brought back up at the Grand Jury level and he would have to be rearrested.

Defense attorney Bryan Hoss noted that the test showed Lorenzen barely over the .08 drunk level in Tennessee.

Prosecutor Neal Pinkston said TBI officials stated they had sent all tests made by Kyle Bayer to an independent lab to be retested. But he said there is no way to know when the tests will be back.

He said some 320 of the Bayer cases being retested are Hamilton County cases.

Attorney Hoss said the Lorenzen case had already been passed several times.

The switched blood alcohol results involved a vehicular homicide charge in Hamilton County that had to be dismissed.
